Chances are that Glasser ( as he should ) will be found guilty as the charge gives weight to the circumstances surrounding the action ( ie overreaction to perceived jeaprody ). IN a fairly accountable American justice system the laying of a charge like this is not frivolous as many jobs can be protentialy on the line if the correct decisions are not made.
